The committee on the judiciary respectfully report that they have had under consideration, so much of the Governor's message as relates to the formation of new counties, and the amendment of the constitution, and that they believe that some change in the constitution is imperiously called for in order to avoid the great difficulties and embarrassments that are likely to arise in consequence of the provisions of our present constitution.

This State already contains fifty-nine organized counties, and it is believed there is ample territory still left to form thirty strong counties in addition to those already in existence.

In order to enable this territory to be organized into convenient counties, and at the same time to avoid an unjust inequality of representation, it will be necessary to amend the constitution.

Our constitution provides that the whole number of the members of the General Assembly, shall never exceed one hundred, and that each county shall be entitled to at least one member. It is manifest that if the number of counties in the State shall hereafter increase to one hundred, that the smallest county will have as large a representation and as much weight in the House of Representatives as the largest and most populous. This would be the adoption of the · rotten borough system in its most odious form, and would be inconsistent with that equality of representation which is the basis of a Republican Government. To enable the Legislature to give to all parts of the State the advantages of separate organization of counties, for the transaction of their legal business, and the regulation of their local affairs, the committee recommend that so much of the constitution, as limits the number of the House of Representatives to onehundred members, and provides that every county shall have at least one member, be repealed. They therefore herewith submit two amend.nents for the consideration of the Senate;

Which said propositions were read a first time, and

Ordered to a second reading.

Mr. Monroe from the standing committee on the Bank, offered the following:

Resolved, That the committee on the bank, whenever they may deem it expé dient, have leave to sit during the hours when the Senate is in session;

On motion of Mr. Sterigere,

Were referred to the committee on Printing.

On motion of Mr. Grimsley,

It was ordered that the report of the warden of the penitentiary be printed for the use of the members and officers of the Senate.

Mr. Darby from the select committee, to whom had been referred so much of the Governor's message as relates to the construction of a rail-road from the City of St. Louis to the Iron Mountain, submitted a report and the following resolution:

Resolved, That it is deemed expedient for the State to aid in the construction of a rail-road from the City of St. Louis to the Iron Mountain, by subscri

bing and taking stock on the terms and in the manner indicated in the foregoing report; and they recommend the passage of a law, creating a company for that purpose, requiring the State to take one third of the stock, so soon as the other two thirds shall have been subscribed, and taken by corporations and individuals. Mr. Neland moved an adjournment,

Which was decided aflirmatively as follows:

AYES--Messrs. Alford, Ashby, Byrd, Campbell, Conger, Danforth, Deguire, Gentry, Gilliam, Gorham, Grimsley, Hunte, Jones of Cooper, Morin, Monroe, Noland, Penn, Pratt. Thompson, and Watts.--20.

NAYS-Messrs. Darby, Glascock, Hyatt, Jones of Pike, Maupin, McDaniel, McIlvaine, Miller, Scott, Sterigere, and Turner.-11. Absent, Messrs. Montgomery, sick; and Rawlins.

Was decided affirmatively as follows:

On motion of Mr. Ashby,

Ordered that the Secretary be not required to spread at large upon the journals of the Senate, the report aforementioned, except so much thereof as embraces the resolution.

Mr. McIlvaine moved,

That the report of the committee on the subject of the Iron Mountain rail road, be printed for the use of the Senate,

Mr. Ashby submitted the following:

Resolved by the Senate, the House of Representatives concurring therein, That the joint committee to investigate the conduct of the Missouri Volunteers in the Florida campaign, be authorized to rent a room for their accommo dation, if necessary,

Which was adopted.

Mr. Penn submitted the following:

Resolved, That the committee appointed to examine the accounts of the Auditor and Treasurer, be authorized to amend said report in the following man

ner:

Strike out $37,427 32, and insert in lieu thereof, $51,019 00, and that the Secretary be directed to make a like alteration in the journal of the Senate, Which was adopted.

Mr. Ashby offered the following:

Resolved that when the Senate adjourns at noon, on Mondays, Wednesdays, and Fridays, they shall adjourn until Tuesdays, Thursdays and Saturdays, unless otherwise ordered by the Senate,

An engrossed bill from the House entitled an act to establish a State road from Jackson in Cape Girardeau county, to Smith's ferry on the Mississippi river in said county,

Mr. Byrd offerred the following as an amendment,

Amend third section by striking out after the phrase "further it shall be the duty of said court," so much of said section as requires the expenses of opening said road to to be paid out of the three per cent. fund, and insert "after said road shall have been opened as above prescribed to cause it to be kept open &c." as is provided in the latter clause of said section and the amendment will read thus: "further it shall be the duty of said court, after said road shall have been opened as above prescribed to cause it to be kept open &c., Which amendment was read,
