that the accused, in criminal prosecutions, shall enjoy the right of a speedy public trial, by an impartial jury of the vicinage, and the means necessary for his defense that, in civil cases, facts tried by a jury shall only be reëxamined according to the rules of the common law... that, in suits at common law, where the value shall exceed twenty dollars, the right of trial by jury shall be preserved that excessive bail shall not be required, excessive fines imposed, or cruel or unusual punishments inflicted.......
