Forms of proceedings before magistrates under the

law concerning Apprentices. Summons of the master for misusing his apprentice. Ulster, to wit : To any Constable of the town of in the said county :THEREAS complaint and information hath been made

unto me one of the Justices of the peace of the said county, by A B, apprentice to C D of - in the said county, Blacksmith, that the said C D hath misused and i" treated him the said A B by cruel punishment, and beat' him the said. A B without just cause, and doth not allot to him sufficient and necessary provision and apparel. (0. the case shall be.) These are therefore in the name of t. people of the state of New York, to command you to summon the said C D to appear before me at the house of at

in the said county, on the day of at the hour of in the afternoon of the same day, to answer unto the same complaint, and to be further dealt with according to law. Herein fail you not. Given under my hand and seal the &c.

Surnmons of the apprentice on complaint of the master. Ulster, to wit : To any constable of the town of - in the said county : TTHEREAS complaint and information hath been made

unto me one of the Justices of the peace of the said county, by C D of in the said county, Blacksmith, that A B, now being an apprentice to him, the said C D, is negligent, stubborn, disorderly, (or as the case shall be) and doth not his duty to the said C D his master. These are therefore to command you to summon the said A B to appear before me at, &c. to answer to the said complaint, and to be further dealt with according to law. Herein fail not.

Recognizance of the master to appear at the Sessions. D E it remembered that on, &c. C D of — in the counD ty of Ulster, Blacksmith; personally came before me

one of the Justices of the peace in and for the said county and acknowledged himself to owe to the people of the State of New-York d ollars to be made and levied of his goods and chattels, lands and tenements, to the use of the said people, if default shall be made in the condition following :

WHEREAS complaint and information hath been made unto me the said Justice, by A B, the apprentice of the said CD, that the said C D hath misused and ill treated him, &c. (as in the summons.) And the said A B and C D now appearing before me in the matter aforesaid, and I not being able to compound or agree the matter between them. The condition of this recognizance is such, That if the said C D do and shall appear at the next general sessions of the peace, to be held in and for the said county, to answer to the complaint aforesaid, and not depart without leave of the court then this recognizance to be void, otherwise of force.

Order of Discharge at the Sessions in pursuance of the pre

ceding complaint. ULSTER, sg. At a general sessions of the peace holden at Kingston, in and for the county aforesaid the day of - before justices, of the people of the state of NewYork, assigned to keep the peace in the said county; and also to hear and determine divers felonies, trespasses and other misdemeanors in the said county committed, it is ordered as follows:

Upon the petition of A B, apprentice to C D of - in the said county, blacksmith, to be relieved upon certain neglects of the said master, in instructing him in his trade, (as the case shall be) and the said master having likewise appeared upon his recognizance, taken before one of the said justices, to answer the complaint of the said petition, and having proved nothing whereby to clear himself of the said complaint, but on the contrary the said A B having given full proof of the truth of the said complaint, to the satisfaction of the court, It is therefore ordered, pronounced and declared by the said court, that the said apprentice shall be

and is hereby discharged and freed from his said apprenticeship. And this to be a final order between the said master and apprentice, any thing contained in their indentures of apprenticeship, or otherwise, to the contrary notwithstanding.

Complaint of Apprentice to three Justices. DUTCHESS, to wit. The information and complaint of A B, apprentice to C D of in the said county, blacksmith, exhibited before us three of the justices of the peace in and for the said county, the day of, &c.

Who saith that he the said A B is an apprentice, bound by indenture to C D of aforesaid, blacksmith ; and that he the said C D hath misused and ill-treated him, the said apprentice and particularly (as the case shall be.) Before us,

Summons thereon to the Master. Dutchess, ss. To any Constable of in the said County.

THEREAS information and complaint hath been made V to us three of the justices of the peace of the said county, by A B apprentice to C D of in the said county, blacksmith ; that he the said C D hath misused and ill-treated the said apprentice, and particularly (as the case may be. These are therefore to require you to summon the said C D to appear before us at, &c. on, &c. to answer unto the said information and complaint. And be you then there to certify what you shall have done in the execution hereof, Herein fail you not. Given under our hands and seals this, &c,

Discharge of the apprentice by the Justices. Dutchess, to wit :} W HEREAS complaint hath been

S Vy made before us three of the Justices of the peace in and for the said county, by A B, apprentice to CD, of in the said county, blacksmith ;

that he the said C D hath misused and ill treated him, and particularly (as the case may be. And whereas the said CD hath appeared before us in pursuance of our summons for that purpose, but hath not cleared himself of and from the said eharge and complaint, but on the contrary the said A B bath made full proof to the truth thereof, before us upon oath : we therefore by these presents do discharge him the said A B, of and from his apprenticeship to the said CP, any thing in the indenture of apprenticeship made between them or otherwise howsoever, to the contrary notwithstanding.

Given under our hands and seals, this, &c.

Complaint to two Justices of the master against the apprentice.

THE complaint and information of Dutchess, to wit: 1 CD of in the said county, Taylor, taken and made on oath before us two of the Justices of the peace in and for the said county, the — day of, &c.

Who saith that A B, apprentice by Indenture to him the said C D, hath, in the service of his apprenticeship, been guilty of several misdemeanors, miscarriages, and ill behav, jour towards him the said C D, and particularly (as the case shall be.)

Warrant thereon against the apprentice. Dutchess, to wit: To any constable of in the said County :

W HEREAS oath bath been made before us two VV of the Justices of the peace in and for the said county, by C D, of in the said county, taylor ; that A B, apprentice to the said C D, hath, in the service of his apprenticeship, been guilty (as in complaint.) These are therefore to require you forthwith to apprehend the said A B, and bring him before us to answer the said complaint and to be dealt with according to law; and you are to give due notice to the said CD, that he appear before us at the same time, to make good the said complaint. Given under our hands and seals, &c.

Commitment of the Apprentice for misconduct, by the Justices.

Dutchess, to wit': TO any constable of — in the said county, and to the keeper of the common gaol of said county. VITHEREAS complaint hath been made before us

I two of the Justices of the peace in and for the said county, upon the oath of C D of - in the said county, taylor, that A B apprentice to the said C D hath in the service of his apprenticeship been guilty [as in complaint.] And whereas upon examination thereof, and upon hearing the allegations of both parties, having come before us for that purpose, and upon due consideration had thereof, it manifestly appears to us that he the said A B is guilty of the premises so charged against him as aforesaid : We do therefore, hereby command you the said constable to take and convey the said A B to the common goal of the said county, and to deliver him to the keeper thereof, together with this warrant. And we do hereby command you the said keeper of the said common goal to recieve the said A B into your custody in the said common goal, to remain at liard labor for the space of Giyen indux our hand and seals the, &c.

Discharge of the Apprentice on the complaint of the master. Dutchess, to wit : W HEREAS complaint&c.Tas in the

(last precedent.] We do therefore, by these presents discharge the said A Bfrom his apprenticeship to the said C D, any thing in any indenture of apprenticeship between them or otherwise to the contrary notwithstanding. Given, &c.

DISTRESS FOR RENT.

PRACTICAL DIRECTIONS.

THE landlord himself may make the distress : but it is

generally made by some other person employed by the landlord for that purpose ; in which case, the landlord must give to the person he employs, a warrant or authority in writing, called a warrant of distress, which is usually in the following form :
