Borthwick, Esq., of Claverton Park, to stop legal proceedings on his part for an assault committed on him by Colonel Napier in the course of last Summer; that certain observations on the same paragraph were afterwards, and before the publishing and composing of the same supposed libellous matter in the introductory part of the plea and in the declaration mentioned, to wit, on the same 2nd January, Napier r. Daniell. 1836. 1836, addressed by the plaintiff to the editor of a certain newspaper called the Bath Guardian, and then published therein; in which said observations the plaintiff did deny in the most unequivocal terms that any money had at any time been given or promised to be given by himself or any other person on his behalf to and for the use of the said T. Newth, to stay legal proceedings against him, or that he, the plaintiff, ever connived at any other person's doing so; that the extraordinary nature of the circumstance in the said supposed libellous matter referred to, as well as common report respecting the same, did then lead him the defendant Welch to believe, and he did in fact then believe, that the plaintiff's statement above mentioned in the said observations published as aforesaid in the said Bath Guardian newspaper, was incorrect as regarded the payment of the said sum of 5l., and the said statement was in fact in that respect incorrect, &c.
