On motion of Mr. Sterigere,

Was ordered to be printed, and

Mr. Campbell from the committee on Engrossed bills, reported as truly engrossed,

"A bill to establish the permanent seat of justice for the county of Benton."

Mr. Montgomery from the joint committee on Enrolled bills, reported, that the committee had examined and found truly enrolled, bills entitled,

"An act to establish an Academy in the town of Paris, Monroe county."

"An act supplementary to an act for taking the census."

"An act respecting chancery practice."

"An act amendatory to an act entitled, 'an act to provide for surveying and marking out certain state roads,"" approved March 7th, 1835. And,

"A joint resolution to allow collectors pay for making out abstracts of the taxable property of non-residents."

Engrossed bills from the House of Representatives entitled,

"An act for surveying and marking out a state road from Elkhorn, by Plattsburg, to the western boundary line."

"A bill concerning traders and pedlers on flat-boats on the Mississippi and other rivers."

"A bill supplementary to an act concerning patrols.' "A bill to incorporate the Missouri College."

Were severally read a second time—and,

Committed to a committee of the Whole House.

Was read a second time, and

Ordered that the title of the first be,

"An act" &c. as aforesaid.

On motion of Mr. Sterigere,

The Senate resolved itself into a committee of the Whole House, Mr. Rawlins in the chair, and after some time spent therein, the committee rose and the chairman reported, that the committee had considered,

"A bill to amend an act to provide for the recovery of debts by attachment." And,

A bill from the House of Representatives entitled,

"An act for surveying and marking out a state road from Elkhorn,

by Plattsburg, to the western boundary line."

Each of which he had been instructed to report without amendment. Also,

Bills from the House of Representatives entitled,

"An act to define the boundaries of Shannon county."

"An act supplementary to an act concerning patrols."

The first mentioned of which he was instructed to report with an amendment and to recommend to the Senate to strike out of the last mentioned bill the first section together with the enacting clause. Also,

A bill from the House of Representatives to incorporate the Missouri College.

Which he was instructed to report, with an amendment.

The Senate agreed to the report of the committee of the Whole, ia relation to the bill to amend an act to provide for the recovery of debts by attachment, and,

It was ordered to be engrossed, and passed to a third reading. The report in relation to a bill to mark out a state road, from Elkhorn by Plattsburg, to the western boundary line, and also, in relation to the bill supplementary to an act concerning patrols,

Was laid on the table.

The report in relation to bills from the House of Representatives, to define the boundaries of Shannon county, and to a bill to incorporate the Missouri College,

Was agreed to, and

The amendments of each, were ordered to be engrossed, and

They were severally ordered to a third reading on to-morrow. Message from the House of Representatives by Mr. Ralls.

MR. PRESIDENT-The Speaker of the House of Representatives has this day signed enrolled bills entitled,

"An act to establish an Academy in the town of Paris, Monroe county."

"An act supplementary to an act to provide for taking the census.' "An act respecting Chancery practice,"

"An act amendatory to an act entitled 'an act for surveying and marking out certain state roads: approved, March 7, 1835. And

"A joint resolution to allow collectors pay for making out abstracts of the taxable property of non-residents.

All of which are herewith submitted for the signature of the presiIdent of the Senate.

The president signed said bills and they were delivered to the committee on enrolled bills, to be presented to the Governor, for his approval and signature.

THE Senate met pursuant to adjournment.

The President laid before the Senate the following communication from the Governor.

EXECUTIVE DEPARTMENT, CITY OF JEFFERSON,
December 31, 1836.

To the Senate of Missouri:

GENTLEMEN-I have this day approved and signed bills of the following titles, to wit:

"An act to charter the Missouri Iron Company, and,
"An act providing for the encouragement of agriculture."

Mr. Sterigere presented a petition of James McCuistion, collector of the county of Jefferson, for the year 1834, praying the passage of an act to relieve him from the payment of a penalty, imposed on him by the Auditor of public accounts, for failing to pay the state the amount due the state, from him as collector aforesaid, within the time prescribed by law, and to allow him compensation for collecting said revenue, which

On his motion,

Was referred to the committee on Claims.

Mr. Campbell from the committee on Engrossed Bills, reported, as truly engrossed,

"A bill to amend an act to provide for the recovery of debts by attachment, also,

Amendments to bills, from the House of Representatives, entitled, "An act to incorporate the Missouri College," and,

An act to define the boundaries of Shannon county."

Mr. Montgomery from the joint committee on Enrolled Bills, reported that the committee had examined and found truly enrolled, "A bill entitled 'an act to attach certain territory to the counties of Clay and Clinton, for civil and military purposes,"

Mr. Valle pursuant to notice asked and obtained leave to introduce, a bill to incorporate the Mine a'Lamotte and Mississippi rail road company,

Which was read a first time, and

It passed to a second reading.

Message from the House of Representatives by Mr. Ralls.

MR. PRESIDENT:-There have been introduced into the House of Representatives, bills, entitled,

"A bill to incorporate the Rocheport rail road company."

A memorial to Congress on the subject of improving the navigation of Grand river."

"A bill to incorporate the St. Louis Gaslight company." And, "A memorial to Congress relating to pre-emption rights to settlers on and adjoining to French and Spanish grants."

I am instructed to inform the Senate that the House insist on their amendments to a bill from the Senate entitled,

"An act to organize counties therein named," to which the Senate disagreed.

The bill and amendments are herewith returned.

On motion of Mr. Ashby,

The report of the committee of the Whole in relation to a bill entitled,

"An act supplementary to an act concerning patrols,"

Was taken up and disagreed to--and,

The bill was ordered to be read a third time on to-morrow.

Mr. Ashby pursuant to notice obtained leave and introduced,

"A bill to legalize the acts of county courts, commissioners of county seats and commissioners of county buildings."

Which was read a first time-and,

It passed to a second reading.

"A bill to recover debts by attachment." Was read a third time and passed.

Ordered that the title be,

"An act" &c. as aforesaid.

Engrossed amendments to a bill from the House of Representatives to incorporate the Missouri College.

Were read a third time.

Mr. Campbell moved

To amend the bill by way of ryder, by striking out of the title the word "Missouri" and insert Kemper,

Which was read a first time,

No objections being made, the ryder was read a second time—and, Was considered as engrossed and was read a third time-and, The bill and amendments together with the ryder passed.

Engrossed amendments to a bill from the House of Representatives entitled,

"An act to define the boundary of Shannon county."

Were read a third time-and,

The amendments together with the bill passed.

On motion of Mr. Ashby

The Senate reconsidered the amendments proposed by the House of Representatives to a bill from the Senate entitled,

"An act to organize new counties therein named." And to which the Senate had disagreed.

Mr. Ashby moved

That the Senate recede from their disagreement to said amendments,

Which was determined in the affirmative as follows:

Ayes-Messrs Ashby, Byrd, Campbell, Deguire, Goforth, Gorham, McClelland, Montgomery, Rawlins, Smith, Sterigere, Vanarsdall, Walsh, Weaver and Williams-15.

Nays-Messrs. Dawson, Lucas and Thompson-3.
Messrs. Lee and McDaniel absent with leave.

Messrs. Jones of Cooper, Jones of Pike, Robison and Valle absent. Engrossed bills from the House of Representatives entitled, "An act for the relief of the heirs of Daniel Doren deceased." "An act to incorporate the Washington county mining company." And,

"An act to incorporate the St. Louis chamber of commerce," Were severally read a first time—and,

They passed to a second reading.
