AN ACT to authorize the Utica and Schenectady rail-road company to convey the mails of the United States. Passed January 27, 1837. It shall be lawful for the Utica and Schenectady States mails. rail-road company, and it shall be the duty of said company, when applied to by the post-master-general to convey the mails of the United States on the said road; and in case they shall not agree with him as to the rate of compensation therefor, and as to the time, manner, and condition of carrying the same, it shall be lawful for the governor of this state to appoint three commissioners, who, or a majority of them, after fifteen days' notice in writing to said company, shall determine and fix the prices, terms, and conditions aforesaid. The People of the State of New-York, represented in Senate and Assembly, do enact as follows: § 1. The treasurer shall pay, on the warrant of the comptroller, to Ebenezer Murdock, five thousand dollars, and interest thereon since the first day of April, eighteen hundred and thirty-six; it being the amount purchased by said Murdock, in a bond held by the state against Nathaniel Leonard, of Lewiston, and belonging to the property and effects of the Niagara bank, sold at auction on the tenth day of September last. The treasurer shall also pay, on the warrant of the comptroller, to said Murdock, five hundred and thirty-four dollars and thirty-nine cents, credited to the bank of Niagara, on the comptroller's book, on the first day of April, eighteen hundred and thirty-six; which was purchased at auction by said Murdock, on the tenth day of September last. § 2. This act shall take effect immediately on the passage thereof. CHAP. 14. AN ACT extending the time for the collection of taxes in the town of Sand-Lake, in the county of Rensselaer. AN ACT to amend an act entitled "An act authorizing the appointment of a supreme court commissioner in the town of Painted-Post, in the county of Steuben," passed April 20, 1836. There shall be appointed, in the manner now prescribed by law, a supreme court commissioner in the county of Steuben, who shall reside in the town of PaintedPost in said county, and who shall possess the powers of a supreme court commissioner as defined and limited in the second article of the second title of the third chapter of the third part of the Revised Statutes. 2. The said act shall be further amended, by inserting New section after the said first section, as above amended, an additional to be added. section in the words following: §2. The commissioner appointed, or authorized to be appointed by the first section of this act, is hereby empowered and authorized to perform all the duties, and execute every act, power and trust, which the first judge of the county courts, of the degree of counsellor in the supreme court, may or could perform and execute out of court, relating to such courts, according to law and the rules and practice thereof. Seventeenth ward. Eleventh ward. Election. Loan of 20, CHAP. 16. AN ACT to divide the eleventh ward of the city of New- Passed February 1, 1837. The People of the State of New-York, represented in Senate and Assembly, do enact as follows: § 1. All that part of the present eleventh ward of the city of New-York, which lies northwesterly of a line drawn from Fourteenth-street through the centre of Avenue B, to Houston-street; thence across Houston-street to the centre of Clinton-street; and thence through the centre of Clinton-street to Rivington-street, is hereby constituted and declared to be an additional and separate ward in the said city, and shall be called the Seventeenth Ward of the city of New-York. § 2. All the residue of the present eleventh ward of the said city, lying southeasterly of the line above mentioned, shall be a distinct and separate ward, and shall be called the Eleventh Ward of the city of New-York. 3. The first election of charter officers under this act, shall take place on the second Tuesday of April next. CHAP. 17. AN ACT authorizing the common council of the city of Buffalo to loan money. Passed February 3, 1837. The People of the State of New-York, represented in Senate and Åssembly, do enact as follows: § 1. The common council of the city of Buffalo are 000 dollars. hereby authorized to borrow, on the credit of said city, a sum not exceeding twenty thousand dollars for the use of the treasury thereof, to be repaid by annual instalments of five thousand dollars each; the first of which instalments shall be due and paid on the first day of October, eighteen hundred and thirty-nine; and the like sum of five thousand dollars shall be due and paid on the first day of October in each and every year thereafter, until the sum so loaned under this act shall be paid. And the said common council are hereby authorized to levy and collect the sums so loaned in pursuance of the authority hereby given, at the time fixed by this act for the repayment of the said loan, together with the annual interest thereon, in addition to the sum or sums now authorized to be levied and collected in said city. § 2.
