AN ORDINANCE TO REPEAL ORDINANCE No. 28, OF THE YEAR [Ord. 17 anno 1829, ENTITULED “AN ACT FOR THE MORE SPEEDY EN. "FORCEMENT OF PECUNIARY PENALTIES, AND TO MAKE “OTHER PROVISIONS IN LIEU THEREOF.”

Enacted 20th August, 1847, published the 25th following, came into operation on publication.

WHEREAS it is necessary to repeal Ordinance No. 28, of the Preamble.

1. Be it therefore enacted by His Excellency the Governor of Ordinance No. British Guiana, with the advice and consent of the Court of Policy thereof, that from and after the publication of this Ordinance, Ordinance No. 28, of the year 1829, entituled "An Act for the "more speedy enforcement of Pecuniary Penalties," shall be repealed.

2. And be it enacted, that from and after the publication of this Pecuniary penalties recoOrdinance, every pecuniary penalty, exceeding the sum of Forty- Verable by eight Dollars, which shall have been declared by any Ordinance or action. Law to be recoverable under, or by virtue of said Ordinance No. 28, of the year 1829, shall be recoverable by action or suit in the Supreme Court of Civil Justice, or in any Inferior Court of Civil Justice of this Colony, according to the amount of such penalty, together with the costs of such action or suit as aforesaid.

3. And be it enacted, that every such action or suit shall be by Action by Attorneyand in the name of Her Majesty's Attorney-General, or other of General. Her Majesty's Law Officers, for and on behalf of Her Majesty.

WHEREAS by an Order in Council of His late Majesty King

WILLIAM the Fourth, bearing date at the Court of St. James, the Twentieth day of June, One Thousand Eight Hundred and Thirtyin Council of one, after reciting, as therein is recited, it was, amongst other 20th June, things, ordered, that in each of the said Courts respectively, thereby meaning, amongst others, the Court of Criminal and Civil Justice of Demerara and Essequebo, and the Court of Civil Justice and the Court of Criminal Justice of Berbice, the said three Judges of the said respective Colonies, thereby meaning, amongst others, the Colony of British Guiana, should, in all civil cases, have, possess, exercise, and enjoy such and the same jurisdiction, powers, and authority in every respect as the Judges of the said Courts had theretofore lawfully possessed, exercised, and enjoyed :
