The cause was remanded, and this is an appeal from a decision adverse to the city rendered upon a rehearing of the cause. The record and the matters assigned therein as for error are in all respects the same as were presented by the record in City of Chicago v. Sherman, 192 Ill. 576, 61 N. E. 850. What was there said as to the alleged errors upon the second hearing in that case is applicable to every contention advanced in this record. Upon the authority of the conclusion there announced, the judgment herein must be, and is, affirmed. Judgment affirmed.

KINGMAN v. PEOPLE ex rel. GANNAWAY, County Collector. (Supreme Court of Illinois. April 16, 1902.) Error to circuit court, Coles county; John P. Harrah, Judge. Application by the people, on the relation of D. C. Gannaway, county collector of Coles county, for judgment against the lots of Carrie Kingman for a special tax for a street improvement. From an order overruling her objections to the application, and from a judg ment for the sale of the lots, she brings error. Reversed. James W. & Edward C. Craig, for plaintiff in error.

PER CURIAM. This case is in all respects like that of Craig v. People, 193 Ill. 199, 61 N. E. 1072, and it is stipulated by the parties that it should be submitted on the same briefs and arguments filed in that case. The result must be the same, and for the reasons stated in the opinion in that case the judgment of the county court will be reversed, and the cause remanded. Reversed and remanded.

STATE v. CLEVELAND, C., C. & ST. L. RY. CO. (Supreme Court of Indiana. April 9, 1902.) Appeal from circuit court, Fountain county; Joseph M. Rabb, Judge. Action by the state of Indiana against the Cleveland, Cincinnati, Chicago & St. Louis Railway Company. From a judgment in favor of defendant, plaintiff appeals. Affirmed. GILLETT, J. The questions involved in this appeal are the same as in State v. Cleveland, C., C. & St. L. Ry. Co. (decided by this court, Oct. 23, 1901) 61 N. E. 669. On the authority of that case the judgment is affirmed.

SPURGEON CENTRAL IRON & STEEL CO. et al. (Appellate Court of Indiana, Division No. 2. April 11, 1902.) Appeal from circuit court, Clay county; S. M. McGregor, Judge. Action by Lydia Spurgeon against the Central Iron & Steel Company and others. From a judgment for defendants, plaintiff appeals. Reversed. E. S. Holliday, and Frank A. Horner, for appellant. George A. Knight, for appellee.

WILEY, J. Appellant was plaintiff below, and her complaint is a duplicate to the complaint in the case of O'Brien v. Steel Co. (decided by the supreme court, March 18, 1902) 63 N. Ě. 302, except as to descriptions of real estate. A demurrer to her complaint was sustained, and, refusing to plead further, judgment was rendered against her for costs. Upon the authority of the O'Brien Case, supra, it must be held that the complaint states a cause of action and that the court erred in sustaining the demurrer to it. The judgment is reversed, and the court below is directed to overrule the demurrer to the complaint.

UNION MUT. BUILDING & LOAN ASS'N v. COULTER et al.1 (Appellate Court of Indiana, Division No. 1. March 18, 1902.) Appeal from circuit court, Clinton county. Action by the Union Mutual Building & Loan Association against David A. Coulter and others. From a judgment sustaining a demurrer to the complaint, and overruling a demurrer to the cross complaint, plaintiff appeals. Reversed. J. E. PER CURIAM. Upon the authority of Association v. Plank, 152 Ind. 197, 52 N. E. 991, the complaint in this cause is held sufficient, and upon the authority of Association v. Aichele (Ind. App.) 61 N. E. 11, the cross complaint is held insufficient. The judgment is therefore reversed, with instructions to the trial court to overrule the demurrer to the complaint, and sustain the demurrer to the cross complaint.
