The court is of opinion that the act passed April 14, 1900, entitled "An act for the protection of life and property in cities of the first grade of the first class" (94 Ohio Laws, p. 611), is unconstitutional, and the demurrer to the petition is therefore overruled, and judgment of ouster rendered against the defendants, on the authority of City of Cincinnati v. Steinkamp, 54 Ohio St. 284, 43 N. E. 490.

CITY OF CHICAGO v. JACKSON. (Supreme Court of Illinois. June 5, 1902.) On rehearing. Petition stricken. For former opinion, see 63 N. E. 1013.

HAND. J. (orally). A petition for a rehearing has been filed in this cause on behalf of the city of Chicago, appellant. Two previous petitions for rehearing have been filed and duly considered by the court in this case,-one by the appellant and the other by the appellee,--both of which petitions were allowed by the court and rehearings of the cause actually had under them, respectively. Under the practice recognized and acted upon in this court, the same party is not permitted to have more than one petition for a rehearing in one and the same It is therefore ordered that the petition for a rehearing by the appellant be, and the same is hereby, stricken from the files. Petition stricken.
