CHAP. 4.

AN ACT to repeal an act entitled "An act prohibiting the issue of Free Passes on the railroads of this State."

PASSED January 17, 1867. The People of the State of New York, represented in Senate and Assembly, do enact as follows :

SECTION 1. Chapter seven hundred and ninety-eight of the laws of eighteen hundred and sixty-six, entitled "An act prohibiting the issue of free passes on the railroads of this state," is hereby repealed.

§ 2. This act shall take effect immediately.

CHAP. 5.

AN ACT to approve the action of the Commissioners appointed in pursuance of chapter six hundred and sixty-six, Laws of eighteen hundred and sixty-six, to locate the Hudson River Asylum for the Insane.

PASSED January 22, 1867; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The action of the commissioners appointed to locate the Hudson River Asylum for the Insane, in pursuance of chapter six hundred and sixty-six of the laws of eighteen hundred and sixty-six, in accepting a site of two hundred and six acres, near the city of Poughkeepsie, tendered as a gift by the citizens of Dutchess county, is hereby approved.

52. This act shall take effect immediately.

CHAP. 12.

AN ACT to amend the act passed February sixteenth, eighteen hundred and fifty-seven, entitled "An act to amend an act entitled 'An act to authorize the formation of corporations for manufacturing, mining, mechanical or chemical purposes,' passed February seventeenth, eighteen hundred and forty-eight." PASSED January 31, 1867.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The second section of the act passed February sixteenth, eighteen hundred and fifty-seven, entitled "An act to amend an act entitled An act to authorize the formation of corporations for manufacturing, mining, mechanical or chemical purposes,' passed February seventeenth, eighteen hundred and forty-eight," is hereby amended so as to read as follows:

2. Whenever any company, formed under said act, shall have fixed the duration of its corporate existence for a less period than it was privileged to do by the first section of said act, it may by a vote of the stockholders representing a majority of the stock, and upon executing and acknowledging a new or amended certificate under its corporate seal, signed by the president and two-thirds of its directors, or trustees, and filing the same in the county where its business shall be carried on, and in the office of the secretary of state, extend the term of its corporate existence from time to time, to a period not longer in the aggregate than it could have originally fixed the same, and shall thereupon possess all the powers and privileges, and be subject to all the liabilities mentioned in said act, during such extension of its existence.

§ 2. This act shall take effect immediately.

CHAP. 32.

AN ACT to amend chapter one hundred and thirty-six, Laws of eighteen hundred and fifty-seven, and chapter two hundred and fifty-seven, of the Laws of eighteen hundred and fifty-three, in relation to Savings Banks. PASSED February 13, 1867. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Section six of chapter one hundred and thirtysix, laws of eighteen hundred and fifty-seven, shall read as follows:

6. Each savings bank or institution for savings, shall pay five dollars towards defraying the expenses incurred in the performance of the duty hereby imposed, and the residue of such expenses shall be paid by them in proportion to the amount of deposits held by them severally, and the sums thus contributed shall be paid into the treasury of the state; but when the deposits of any such savings bank or institution for savings are less than five hundred dollars, it shall be exempt from such contribution. If any savings bank or institution for savings shall, after due notice, refuse or neglect to pay its proper share of charges so alloted, then the said superintendent may maintain an action against such savings bank or institution for savings, for the recovery of such charges.

$2. Upon the organization of any savings bank or institution for savings, it shall be the duty of the secretary, or some officer thereof, before receiving any deposits, to transmit to the superintendent of the banking department, a list of the officers of such savings bank or institution for savings, with their post-office address and the location of such savings bank or institution for savings.

3. Section five of chapter two hundred and fifty-seven, Laws of eighteen hundred and fifty-three, is hereby amended by striking out the words following, to wit: "nor a larger amount than three millions of dollars, in the aggregate amount of deposits exclusive of its banking house."

$4. This act shall take effect immediately.

CHAP. 49.

AN ACT to amend an act entitled an act to authorize the formation of railroad corporations and to regulate the same, passed April second, eighteen hundred and fifty.

PASSED March 1, 1867.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Section thirty-six of the act entitled "An act to authorize the formation of railroad corporations and to regulate the same," passed April second, eighteen hundred and fifty, is hereby amended so as to read as follows:
