IN THE YEAR OF OUR LORD ONE THOUSAND EIGHT HUNDRED AND FORTY-FIVE. AN ACT additional to the seventy seventh chapter of the Revised Statutes. Be it enacted by the Senate and House of Represent2 atives in Legislature assembled as follows: 3 SECTION 1. Any bank which shall violate either of 4 the provisions of the twenty sixth section of the act to 5 which this is additional, as qualified by the twenty 6 seventh section of said act, or which shall violate the 7 provisions of the thirty second section of said act shall 8 incur the same forfeiture, to the same use, and to be 9 recovered in the same manner as is provided in the 10 fifty seventh section of the chapter aforesaid. SEC. 2. It shall be the duty of the bank commis2 sioners at any time when they have cause to suspect 3 that any bank has incurred the forfeiture referred to Wm. T. Johnson, Printer to the State. 4 in the foregoing section, to give immediate informa5 tion thereof to the governor, in order that he may re6 quire agreeably to the provisions of the fifty second 7 section of the chapter aforesaid, a return from such 8 bank to be made for such month as the information 9 aforesaid may indicate. SEC. 3. It shall be hereafter unlawful for any bank 2 to dispose of any of its bank note plates or dies, in 3 any way which may lead to a fraudulent use of the 4 same, and upon the surrender or expiration of the 5 charter of any bank it shall be the duty of such bank 6 before closing its concerns to produce to the bank 7 commissioners satisfactory evidence that every plate 8 as aforesaid belonging to any such bank has been 9 cither defaced or destroyed, or so otherwise disposed 10 of as to secure the public against any fraudulent usc 11 of the same; and any bank owning such plates or 12 dies which shall neglect or refuse to comply with the 13 requirements of this section shall forfeit a sum not 14 exceeding five hundred dollars to the use of the State, 15 to be recovered by the treasurer thereof. |
