AN ACT to Amend Section 1, of Chapter 4019, of the Laws of Florida, the Same Being an Act Entitled an Act to Amend Section 2 of an Act Approved February 28, 1883, Entitled an Act to Prescribe a Mode Whereby Counties May Erect Court Houses and Other Buildings, Approved May 4, 1891.

Be it enacted by the Legislature of the State of Florida:

SECTION 1. That Section 1 of Chapter 4019 of the Laws of Florida, entitled an act to amend Section 2 of an act approved February 28, 1883, entitled an act, to prescribe a mode whereby counties may erect court houses and other buildings, approved May 4, 1891, be and the same is hereby amended to read as follows:

SECTION 1. That Section 2 of an act approved February 28, 1883, entitled an act to prescribe a mode whereby counties may erect court houses and other public buildings, approved February 28, 1883, be amended to read as follows: Section 2. The taxes levied shall be assessed and collected at the same time, and in the same manner as other State and county taxes are collected. The contract for the building of such court house, or other public building or buildings shall be in writing and shall be filed in the office of the Clerk of the public buildCircuit Court, and the said contract shall provide that the whole amount due for the building of such court house or other public building, shall not be paid until the said building or buildings shall have been inspected by the County Commissioners, and twenty per cent. of the original contract for the erection of said building or buildings shall remain unpaid until such inspection by the County Commissioners is made and the court house or other public building or buildings is accepted by the County Commissioners.

SEC. 2. This act shall go into effect immediately upon its passage and approval by the Governor.

May 30, 1893, Entitled an act to Amend Section Thirteen Hun-
dred and Sixty-six of the Revised Statutes of the State of
Florida, in Regard to the Terms of the Circuit Court of the
First Judicial Circuit of Florida.

Be it enacted by the Legislature of the State of Florida:

SECTION 1. That Section 1, Chapter 4226, Laws of Florida, approved May 30, 1893, be amended to read as follows:

1366. First Judicial Circuit, Spring Term-Santa Rosa, third Monday in March; Escambia, first Monday in April; Walton, first Monday after third Monday in April; Holmes, second Monday after fourth Monday in April; Washington, third Monday after fourth Monday in April; Jackson, fifth Monday after fourth Monday in April.

AN ACT to Repeal Chapter 3936, Laws of Florida, Being an Act to Establish a Criminal Court of R cord in the County of Putnam in the State of Florida, Approved May 27, 1889.

Be it enacted by the Legislature of the State of Florida:

SECTION 1. That Chapter 3396, Laws of Florida, being an act to establish a Criminal Court of Record in the county of Putnum in the State of Florida, approved May 27, 1889, be and the same is hereby repealed.

SEC. 2. That the Clerk of the said Criminal Court of Record shall transfer to the office of the Clerk of the Circuit Court in and for said county of Putnam ali books, papers, informations and records now belonging to said Criminal Court of Record, and the Clerk of said Circuit Court shall forthwith transfer the papers in all suit so transferred wherein the Circuit Court has no jurisdiction to the Justices of the Peace in said county having jurisdiction over the same.

SEC. 3. This act shall take effect thirty days after its passage and approval by the Governor.

CHAPTER 4593-[No. 79.]

AN ACT Prescribing a Penalty for Landing Sick Seamen or Paupers in the Seaports of the State of Florida.

Be it enacted by the Legislature of the State of Florida:

1897.

SECTION 1. If any master or commander of any ship or vessel shall discharge or cause to be put ashore any sick or disabled sailor or sailors belonging to his ship or vessel, not entitled to his or their discharge by the contract between them, or any servant, without taking due care of his or their maintenance and cure, or who shall land from any such ship or vessel any pauper or vagrant, without the means of procuring his or her or their maintenance for the space of one month in any port of the State of Florida, he shall be deemed guilty of a misdemeanor, and shall upon conviction be fined Penalty. in a sum not more than one hundred dollars, or he imprisoned for a period of not more than sixty days, or by both such fine and imprisonment.

SEC. 2. All laws or parts of laws in conflict with the provisions of this act be and the same are hereby repealed. Approved April 3, 1897.

AN ACT to Authorize the Construction and Maintenance of Gates
Across the Public Roads in this State, and to Provide for the
Removal of the Same.

Be it enacted by the Legislature of the State of Florida:

SECTION 1. That the Boards of County Commissioners of the several counties of this State are hereby authorized to permit the construction of gates across the public roads of their respective counties whenever, in their opinion, the same will not unnecessarily interfere with the public travel.

SEC. 2. That at the time of granting such permit the said Boards of County Commissioners shall prescribe the place where such gate may be placed and the manner of its construction and maintenance.

AN ACT for the Improvement of the Public Roads and Bridges in Hillsborough County, Providing for the Employment of Convicts Under Certain Conditions, and for the Levy and Collection of a Road and Bridge Tax, and the Means of its Expendi

Be it enacted by the Legislature of the State of Florida:

SECTION 1. The Commissioners of the county of Hillsborough in this State shall at their regular meeting in July, 1897, and biennially thereafter, elect a County Superintendent of Roads and Bridges, to serve for two years. They shall fix the amount of the bond to be given by said Superintendent and the amount of salary to be paid for his services, and it shall be their duty to remove the Superintendent for neglect of duty, incompetency, or conduct detrimental to the pulic service.

SEC. 2. All roads and bridges shall be constructed and Construction of repaired according to plans, specifications and rules adopted by the County Commissioners, said board shall also fix the maximum rate of wages to be paid each class of labor employed by the County Superintendent of Roads and Bridges. SEC. 3. No member of the Board of County Commissioners, clerk or other employe of any department of the public from serving as service of the county, shall serve as an agent for the sale to the county of any road working machinery, tools or material, or have any interest, direct or indirect, in any profit which may arise from such sale under penalty of dismissal from the service or office.

SEC. 4. The Superintendant of Roads and Bridges shall have supervision of the construction and repair of all public roads and bridges in the county, under written directions Superintendent and specifications of the County Commissioners; he shall employ the necessary labor giving preference to citizens of the

county, he shall have charge of all road and bridge material, tools, machinery and all road working property owned by the county, he shall give bond for the proper discharge of his duties and the safety and care of all county property under his charge. The Superintendent shall keep a book in which he shall record in detail all public work done in his department, the kind and location of the work, when and by whom done. He shall make out a monthly report showing the details above enumerated, and the amount of wages due each employe in his department, he shall file said report with the clerk of the Board of Commissioners in time for the first regular meeting of the County Commissioners thereafter. The Superintendent shall certify under oath the correctness of his report. The County Commissioners shall audit the same, and provide for the payment from the road and bridge fund of the several claims due; Provided, That nothing contained in this act shall be construed to prohibit the County Commissioners of said county from having any public road worked by contract, or any bridge erected or repaired under the existing State laws.

SEC. 5. The Board of County Commissioners of said county shall at the time for levying taxes for county purposes, levy a tax for public roads and bridges not exceeding three mills on the dollar, on all the real and personal property in the county subject to taxation, which shall be assessed and collected as other taxes of the county, and the moneys arising therefrom shall be paid into the county treasury to be expended solely for the purpose of providing for the laying out, constructing and maintaining public roads and bridges, and procuring all things necessary thereto.

SEC. 6. That when found necessary to construct or repair any bridge or road and it is deemed best to have the same done by contract, the County Commissioners shall pass upon the plans and specifications, after which bids may be invited by publication, for the material or work to be done, and the bid or bids approved by the County Commissioners shall be accepted and a contract entered into with the bidders.

SEC. 7. Whenever it shall be necessary to use forest timber or unworked stone in repairing or improving a public road, the Superintendent is authorized to take such timber or stone as may be necessary, and if the owner of such timber or stone shall demand payment, the Superintendent shall summon three disinterested free holders to appraise such timber or stone, which shall be paid for by the County Commissioners from the road and bridge fund.
