or either of them shall become due and payable, or within sixty days thereafter, with five per centum damages thereon, and all costs; and I hereby acknowledge myself bound for the payment of any deficiency in the amount of principal, interest, and costs so due, after such sale, to be recovered by said commissioner or his successors in office, by action of debt, in any court of competent jurisdiction. TRUSTEES OF SCHOOLS.

The qualified voters in each congressional township are authorized to elect three trustees, who hold their offices for the term of three years, and until their successors are elected and qualified. The persons so elected are styled the "Trustees of School Township No.

," and before entering on the duties of their respective offices, they are required to be sworn to discharge the duties enjoined upon them by law. The trustees appoint a township clerk, who is in like manner sworn to the faithful discharge of the duties of his office.

The board of trustees thus organized, are empowered to divide the school lands into such lots as will best suit purchasers, and ensure the best price for the land; and also to fix a minimum price to each lot, not less than one dollar and twenty-five cents per acre; and it is the duty of the clerk to certify such division and valuation to the school commissioner of the proper county, to be by him recorded in a book provided by the county for that purpose. Rev. L. 464, 5.

It is also the duty of the trustees of each school township in which the school section has been sold, to call a meeting of the qualified voters of such township, and take their votes, as to the disposition of the moneys arising from such sale; and the said moneys are to be deposited in the state loan office, or loaned by the school commissioner of the proper county, in conformity with the vote so taken, which vote is to be recorded in the record book of the township, by the clerk thereof and certified to the school commissioner of the proper county. Id. 467, 8.

It is the further duty of the trustees, to divide the township into school districts, and appoint three subtrustees in each district; to receive from the sub-trustees a report of the decision of the voters of the respective districts, as to their willingness to support public schools, and cause the same to be recorded by the township clerk; and also to examine school houses, and name them, and number them in the order of time in which they are finished; and cause the name and number of each to be recorded in the record book of the township. Id. 473, 4, 5.

The form of the oath required of trustees is similar to that required of a school commissioner.
