proof that he has figned a contract within the intent and meaning of this act, and that the voyage agreed for is not finifhed, altered, or the contract otherwife diffolved, and that fuch feaman or mariner has deferted the fhip or veffel, or abfented himself without leave, the faid juftice fhall commit him to the houfe of correction or common gaol of the city, town or place, there to remain until the faid fhip or veffel fhall be ready to proceed on her voyage, or till the master fhall require his difcharge, and then to be delivered to the faid mafter, he paying all the coft of fuch commitment, and deducting the fame out of the wages due to fuch feaman or mariner.

Sec. 8. And be it ena led, That every fhip or veffel belonging to a citizen or citizens of the bound tobe United States, of the burthen of one hundred furnished and fifty tons or upwards, navigated by ten or more perfons in the whole, and bound on a voyage without the limits of the United States, fhall be provided with a cheft of medicines, put up by fome apothecary of known reputation, and accompanied by directions for adminiftering the fame; and the faid medicines fhall be examined by the fame or fome other apothecary, once at leaft in every year, and fupplied with fresh medicines in the place of fuch as fhall have been used or fpoiled; penalty on and in default of having fuch medicine-cheft the matter fo provided, and kept fit for ufe, the master or commander of fuch fhip or vessel shall pro

Sec. 9. An Act impofing Duties on the Tonnage of Ships

E it enacted by the Senate and House of Reprefentatives of the United States of America in Congress affembled, That upon all fhips or veffels which after the first day of September next, fhall be entered in the United States from any foreign port or place, there fhall be paid the feveral and refpective duties following, that is to fay: On on this or fhips or veffels of the United States, at the vellels of rate of fix cents per ton; on fhips or veffels built within the United States after the twenon thofe of tieth day of July laft, but belonging wholly or foreigners; in part to fubjects of foreign powers, at the on all others rate of thirty cents per ton: on other fhips or veffels at the rate of fifty cents per ton.

Sec. 2. And be it further enacted, That the aforefaid duty of fix cents per ton, fhall be alfo paid upon every fhip or veifel of the United States which after the faid firft day of September next, fhall be entered in a diftrict in one ftate from a district in another ftate, other than an adjoining ftate on the fea coaft or on a navigable river, having on board goods, wares, and merchandize taken in one ftate to be delivered in another ftate: Provided, That it fhall not be paid on any fhip or veffel having a licenfe to trade between the different diftricts of the United States, or to carry on the bank or whale fifheries whilft employed therein, more than once a year:

Be it therefore further enacted, That reftitution in all cafes in which the faid foreign duty to be made fhall have been heretofore paid on fhips or not, deveffels of the United States, whether register- mandable ed at the time of payment or afterwards, reftitution thereof fhall be made, and that no fuch foreign duty fhall hereafter be deman ded on the said ships or veffels.

Sec. 5. And be it further enacted, That the act, intituled, " An act impofing duties on tonnage," fhall, after the faid first day of September next be repealed, and fhall thenceforth VOL. I.
