floor above the second, or for whom working, sleeping or living accommodations are provided on any floor above the second.

(d) In all such buildings of fireproof construction, interior fire-escapes may be substituted for stairway fire-escapes, provided such interior fireescapes shall comply with all the requirements of this Act relating to fireproof stairways.

233. MACHINERY INSPECTION.] It shall be the duty of the State Factory Inspector to inspect all machinery in use in all buildings of Class IV; and he shall have authority to direct that said machinery shall comply with the requirements of "An Act to provide for the health, safety and comfort of employees in factories, mercantile establishments, mills and work shops in this State and to provide for the enforcement thereof." (Approved June 4, 1909, in force Jan. 1, 1910.)

234. SPECIAL REQUIREMENTS.] The following special requirements shall not be construed as excluding any of the general provisions of this Act. SPECIAL PROVISIONS FOR CLASS IVA BUILDINGS HOSPITALS, SANITARIUMS, BENEVOLENT INSTITUTIONS.

235. STORY HEIGHT OF ROOMS.] The story heights of attendants' sleeping rooms in buildings of Class IVa shall not be less than 9 feet; and the story heights of patients' or inmates' sleeping rooms shall not be less than 10 feet.

236. DIMENSIONS OF ROOMS.] (a) The rooms of Class IVa shall be as follows:

(b) No bedroom shall have less than 100 square feet or less than 900 cubic feet of air space, except as hereinafter provided.

(c) In every ward, dormitory or bedroom, there shall be not less than 80 square feet of floor area nor less than 800 cubic feet of air space for each bed or patient.

237. WINDOWS.] (a) Each bedroom, ward or dormitory for patients in buildings of Class IVa shall have its windows opening on a street, alley, yard or outer court. Bed rooms or dormitories for attendants shall have a window or windows opening to a street, alley, yard, outer, lot-line, or inner court.

(b) There shall be not less than 10 square feet of glazed sash openings per patient in each room, ward or dormitory used as sleeping accommodations by patients; and windows shall be arranged so that not less than one half of the required area may be open at the same time.

(c) Every room containing a water closet or urinal shall have at least one window with a glazed area of at least 6 square feet and a minimum width of 1 foot, opening upon a street, alley, court, yard or vent shaft.

(d) Windows of any bedroom opening on a vent shaft shall have fixed sash and glass.

(e) Windows guarded by iron bars or gratings used in buildings of Class IVc or in asylums shall be arranged so that not less than one half of the area of glazed sash required by paragraph (b) may be open for ventilating at the same time.

238. ISOLATION WARD.] Every hospital shall have for each 100 patients or fractional part thereof a suite of rooms thoroughly isolated from the remainder of the hospital for the use of patients having an infectious disease developed within the walls of the institution. Such suites shall have complete plumbing facilities and shall be maintained in a clean sanitary condition, ready for instant use. The requirements for buildings of Class IVa shall govern the construction, arrangement and equipment of such suite or building. Such suite or buildings shall have accommodations for at least two patients and the necessary nurses.

239. MORGUE.] There shall be provided in each building of Class IVa a suitable room for the proper care of the dead pending their removal.

SPECIAL PROVISIONS FOR CLASS IVb BUILDINGS-ASYLUMS AND REFORMATORY

INSTITUTIONS.

240. STORY HEIGHT OF ROOMS.] The story height of attendants' sleeping rooms in buildings of Class IVb shall not be less than 9 feet, and the story heights of patients' or inmates' sleeping rooms shall not be less than 10 feet.

241. DIMENSIONS OF ROOMS.] The rooms of Class IVb shall be as follows: (a) No bedroom shall have less than 100 square feet of floor area, or less than 900 cubic feet of air space.

(b) In every ward or dormitory there shall be 80 square feet of floor area and not less than 800 cubic feet of air space for each bed or patient.

242. WINDOWs.] (a) Each bedroom, ward or dormitory for patients in buildings of Class IVb shall have its windows opening on a street, alley, yard, or outer court. Bedrooms or dormitories for attendants shall have a window or windows opening on a street, alley, yard or court.

(b) There shall be not less than 10 square feet of glazed sash opening per patient in each room, ward or dormitory used as sleeping accommodations by patients; and windows shall be arranged so that not less than onehalf of the required area may be open at the same time.

(c) Every room containing a water-closet, or urinal compartment shall have at least one window with a glazed area of at least 6 square feet and a minimum width of 1 foot opening upon a street, alley, court, yard or vent shaft.

(d) Windows of any bedroom on a vent shaft shall have fixed sash and glass.

(e) Windows guarded by iron bars or gratings used in buildings of Class IVc or in asylums shall be arranged so that not less than one-half of the area of glazed sash required by paragraph (b) may be open for ventilating at the same time.

244. FIRE-ESCAPES.] (a) All buildings of Class IVb, two or more stories in height, shall be equipped with one or more stairway fire-escapes placed as far as practicable from the interior stairs, and not less than 3 feet in width, with platforms not less than 3 feet wide at each floor level, and with openings from each floor directly to said platforms. Such platforms may be of smooth, incombustible material.

(b) In all such buildings there shall be a stairway fire-escape located as near as practicable to the end of each corridor, unless there is a stairway at the end of the corridor; and where a corridor is endless the fire-escapes may be located around and connected to said corridor at approximately equal distance.

(c) In all such buildings there shall be at least one stairway fire-escape for each 100 persons or fractional part thereof who habitually occupy any floor above the second, or for whom working, sleeping or living accommodations are provided for on any floor above the second.

(d) In all such buildings of fireproof construction, interior fire-escapes may be substituted for stairway fire-escapes, provided such interior fireescapes shall comply with all the requirements of this Act relating to fireproof stairways.

SPECIAL PROVISIONS FOR CLASS IVC BUILDINGS-POLICE STATIONS, JAILS, ETC.

245. ROOMS, CELLS, VENTILATION OF.] (a) Every room or cell in which one or more persons are confined, in buildings of Class IVc, shall be provided with artificial ventilation, which shall be in operation at all times. The air shall be tempered and heated when the outside temperature requires the windows to be kept closed or when the outside temperature is below 60 degrees Fehrenheit. Said artificial ventilating apparatus shall supply each and every person confined in said room or cell with at least 1,500 cubic feet of fresh air per hour. Fresh air shall be introduced into each cell at the end opposite the door. The cell and cell house shall have openings properly located and of sufficient area to permit the escape of the volume of air required to be supplied by this Act.

(b) All cells other than dungeons shall have at least one side or end constructed of bars, spaced as far apart as possible consistent with good jail construction. The ends or sides of cells containing bars shall face a wall containing windows. The glass surface of such windows shall be equal to one-fifth the area of the wall. Such windows shall be arranged so that not less than one-half of the required area may be open at the same time.

246. CELL, SIZE OF.] The space within the cell enclosure shall have at least 500 cubic feet and at least 50 square feet of floor area per person confined therein. The distance from floor to ceiling shall not be less than 7 feet. 247. DIMENSIONS OF ROOMS.] In every building hereafter erected or converted to the purpose of Class IVc every sleeping room other than cells or cell room shall have not less than 80 square feet of floor area nor less than 800 cubic feet of air space for each inmate.

248. AIR SUPPLY, HOW HEATED.] The air supply for buildings of Class IVc arranged to confine ten or more persons shall be tempered by low pressure steam heat or hot water.

249. ARTIFICIAL ILLUMINATION.] Artificial illumination by means of electricity or gas shall be provided for each cell by placing an electric lamp or gas jet in front of the cell door before a special opening in such a manner that light rays from such lamp or jet will pass into the cell. Artificial illumination outlets placed in cells or within reach of an inmate shall be for electric illumination, and no other means.

250. CELLS, SANITATION OF.] Every cell shall have a water-closet, and a lavatory connected with drains and running water. The closet and lavatory drains and water supply shall be of the materials and construction required by this Act. The floor shall be of stone, tile, concrete, asphalt, steel or other impervious materials.

251. LAVATORIES.] Every building of Class IVe shall have at least one bath tub or shower bath for every 50 inmates or fractional part thereof.

ARTICLE IX.

CLASS V BUILDINGS.

255. CLASS V DEFINED.] In Class V shall be included all buildings used for manufacturing or storage purposes, such as:

(a) Mills, factories, workshops.

(b) Grain elevators and power houses.

GENERAL REQUIREMENTS FOR CLASS V BUILDINGS.

257. TYPE OF CONSTRUCTION.] Every building hereafter erected for, or converted to, the purposes of Class V shall be built as follows:

(a) If more than 90 feet high, it shall be built of fireproof construction. (b) If less than 90 feet and more than 50 feet high, it shall be built of slow-burning, or mill, or fireproof construction.

(c) If less than 50 feet high and more than two stories, it shall be built of composite, or slow-burning, or mill, or fireproof construction.

(d) If not more than two stories high, it may be built of frame construction unless it is located within the fire limits of cities, towns and villages.

258. INCOMBUSTIBLE PARTITIONS.] (a) The partitions between the areas occupied by different persons, firms or corporations on any one floor, shall be built of incombustible material from the floor to the floor boards or roof boards next above.

(b) Only approved metal-framed windows glazed with one quarter inch approved wired glass may be used in such partitions.

260. DISPLAY OF PLACARD INDICATING SAFE LIVE LOAD OF FLOOR.] (a) In each story of every building used for the purposes of Class V, the owner, agent, occupant or person in charge or possession, must post a placard in a conspicuous place stating the maximum safe live load per square foot of floor, or for each particular portion of such floor, if the safe load be not uniform. It shall be unlawful to load any floor, or portion thereof in excess of this stated maximum safe live load.

(b) These placards must be posted and continuously maintained during the entire period of the use of the building for this purpose. Before posting them, such placards shall be verified and approved by the local or State Building Commissioner.

261. PRIVIES AND WATER CLOSETS.] (a) Every building of Class V shall be provided with a sufficient number of water closets, earth closets or privies, with reasonable access of the persons employed therein; and such water

closets, earth closets or privies shall be provided in the proportion of at least one to every thirty male persons, and one to every twenty-five female persons. Whenever both male and female persons are employed, said water closets and privies shall be provided separately and apart for the use of each sex, and shall be plainly marked to show by which sex they are to be used; and no person or persons shall be allowed to use the closets or privies assigned to the opposite sex.

(b) Such water closets or privies shall be constructed in an approved manner, and shall at all times be kept in clean and sanitary condition.

(c) A room containing one or more closets or privies shall have an enclosure constructed of complete partitions from floor to ceiling with proper doors and a window opening to the outer air. Such window shall have a glazed area of at least one-tenth of the floor area of the room.

(d) Nothing in this section shall be construed to prevent any city, town or village, by appropriate ordinance or regulations, from prohibiting the construction, use or maintenance in such city, town or village of any kind of closets or privies which may be considered a nuisance or detrimental to the public health.

262. WASHING FACILITIES.] (a) In all buildings of Class V adequate washing facilities shall be provided for the employees where necessary. In such case in all factories, mills and workshops not less than one spigot, basin or receptacle with suitable water supply shall be provided for each 10 employees. In mercantile establishments, not less than one spigot, basin or receptacle with sufficient water supply shall be provided for each 20 employees. (b) Where the labor performed by the employees is of such character as to make customary or necessary a change of clothing by the employees, there shall be provided sanitary and suitable dressing room or rooms; and both such dressing rooms and washing facilities shall be separately maintained for each sex.

(c) Nothing in this Act shall be construed as abrogating or repealing any provision of section 5 of an Act entitled, “An Act to provide for the licensing of plumbers, and to supervise and inspect plumbing," approved June 10, 1897, and in force July 1, 1897; or the provisions of any local ordinance or regulation of any city, town or village, requiring approved and sufficient methods of sanitation, light, heat, drainage or ventilation of an equal or superior standard to that required in this Act.

263. VENTILATION.] (a) In every room or apartment of any building of Class V where one or more persons are employed and where lights consuming oxygen are used, at least 500 cubic feet of air space shall be provided for each and every person employed therein; provided when lights not consuming oxygen are used, 250 cubic feet of air space for each person employed therein shall be deemed sufficient. Provision shall be made for supplying fresh air to the amount specified in this Act, in such manner as not to create injurious drafts nor cause the temperature to fall materially below the average temperature maintained.

(b) All rooms or apartments in any building of Class V, having 2,000 cubic feet or more of air space for each and every person employed in each room or apartment, and having outside windows whose combined area is at least 20 square feet for each and every person employed therein, shall not be required to have artificial ventilation.

(c) All rooms or apartments in any building of Class V, having a combined area of outside windows of less than 20 square feet for each and every person employed therein, shall be provided with artificial ventilation which will supply not less than 1,800 cubic feet of fresh air per hour for each and every person employed therein.

(d) All rooms or apartments having less than 2,000 cubic feet of air space for each and every person employed therein, shall be provided with artificial ventilation which will supply not less than 1,800 cubic feet of fresh air per hour for each and every person employed therein: Provided, that when such rooms or apartments have outside windows whose combined area is at least 20 square feet for each and every person employed therein, this artificial ventilation need only be in operation when the outside tem. perature requires the windows to be kept closed, and then only to the extent of furnishing 1,500 cubic feet of fresh air per hour for each and every person

employed therein. The preceding portions of this section shall not apply to those rooms or apartments in which manufacturing processes are carried on, which from their peculiar nature would be materially interfered with by the requirements of this section.

(e) No part of the fresh air supply required by this section shall be taken from any cellar or basement.

(f) The air space available for each person shall be the total interior volume of the room or apartment, expressed in cubic feet, divided by the average number of persons employed in such room or apartment.

(g) The means for ventilation of all buildings of Class V, whether by windows or doors, or by mechanical process, shall be sufficient to remove all poisonous or noxious gases or fumes arising from any process, and all dust of a character injurious to the health of the persons employed, which is created in the course of any manufacturing process within such building.

264. REPEALING CLAUSE.] Sections 11 and 12 of an Act to provide for the health, safety and comfort of employees in factories, mercantile establishments, mills and workshops, in this State, and to provide for the enforcement thereof, approved June 4, 1909, and in force January 1, 1910, are hereby repealed.

SPECIAL PROVISIONS FOR CLASS Vb BUILDINGS-GRAIN ELEVATORS.

265. GRAIN ELEVATORS.] (a) Engines, boilers, power-generating apparatus, furnaces and other apparatus containing fires required in connection with grain elevators shall be in separate rooms of fireproof construction as described in this Act. The walls between such rooms and the elevator shall be masonry dividing walls not less than 17 inches in thickness. Openings in such walls shall have double automatic closing fire doors built and maintained as described in this Act.

(b) There shall be at least one flight of stairs from the highest floor or landing to the ground and a door opening to the open air at its base.

(c) It shall be the duty of the State Factory Inspector to inspect all machinery in use in said elevator buildings, and he shall have authority to direct that the machinery used in all such elevators shall comply with the requirements of this Act and of "An Act to provide for the health, safety and comfort of employees in factories, mercantile establishments, mills and work shops in this State and to provide for the enforcement thereof," approved June 4, 1909, in force January 1, 1910, Laws of 1909.

ARTICLE X.

CLASS VI BUILDINGS.

270. CLASS VI DEFINED.] In Class VI shall be included:

(a) Office buildings.

(b) Mercantile establishments.

GENERAL PROVISIONS FOR CLASS VI BUILDINGS.

271. CONSTRUCTION, FORM OF.] (a) Construction of all buildings of Class VI shall be in accordance with the following requirements:

(b) Buildings five stories or over 90 feet in total height above sidewalk shall be of fireproof construction.

(c) Buildings not exceeding four stories or 50 feet in height shall be of mill or slow-burning or fireproof construction.

(d) Buildings not over three stories or 40 feet in height shall be of composite, mill, slow-burning or fireproof construction.

(e) Buildings not more than two stories or 30 feet in height may be of frame construction.

272. INCREASING HEIGHT OF BUILDINGS.] In all cases when buildings of Class VI in existence of the passage of this Act are to be increased in height, such building after completion must conform to the requirements of this Act.

273. EXIT DOORS.] (a) Exit doors of buildings of this class shall open outward. Said exit doors shall not be locked or fastened during the time the
