Senate met pursuant to adjournment.

Hon. Fred E. Sterling, Lieutenant Governor and President of the Senate, presiding.

Prayer by the Chaplain.

The President of the Senate announced that he had examined the Journal of Tuesday, March 13, 1923, and found no corrections to make, and unless some Senator had corrections to offer, the Journal would stand approved. No corrections being offered the Journal was ordered to stand approved.

REPORTS FROM STANDING COMMITTEES.

Mr. Hamilton, from the Committee on Enrolling, Transcribing and Typing Bills reported that bills of the following titles have been cor rectly engrossed and are returned herewith:

SENATE BILL No. 75.

A bill for "An Act to repeal 'An Act to authorize the formation of companies for the detection and apprehension of horse thieves and other felons,' returned by the Governor July 7, 1885, to the Secretary of State without his approval or veto, as subsequently amended by an Act returned by the Governor June 28, 1887, in force July 1, 1887, and by an Act approved June 27, 1921, in force July 1, 1921."

SENATE BILL No. 132.

A bill for "An Act to create the Spanish-American War Memorial Commission, to define its duties and to make an appropriation therefor."

Mr. Jewell, from the Committee on Elections, to which was referred a bill, Senate Bill No. 45, for "An Act to amend section 4 of Article VI of 'An Act regulating the holding of elections and declaring the results thereof in cities, villages and incorporated towns in this State,' approved June 19, 1885, as amended, and to add to Article IV of said Act section 51/2."

Reported the same back with amendments thereto, and recommended that the amendments be adopted, and that the bill as amended do pass, and that it be ordered to a first reading.

Under the rules, the bill was ordered to a first reading, and the amendments were ordered printed.

Mr. Jewell, from the Committee on Elections, to which was referred a bill, Senate Bill No. 50, for "An Act to amend section 86 of 'An Act in regard to elections, and to provide for filling vacancies in elective offices,' approved April 3, 1872, in force July 1, 1872, as amended, and to add section 5511⁄2 thereto."

Reported the same back with amendments thereto, and recommended that the amendments be adopted, and that the bill as amended do pass, and that it be ordered to a first reading.

Under the rules, the bill was ordered to a first reading, and the amendments were ordered printed.

Mr. Jewell, from the Committee on Elections, to which was referred a bill, Senate Bill No. 44, for "An Act to amend section 51 of 'An Act to provide for the holding of primary elections by political parties,' approved March 9, 1910, in force July 1, 1910, as amended."

Reported the same back with an amendment thereto, and recommended that the amendment be adopted, and that the bill as amended do pass, and that it be ordered to a first reading.

Under the rules, the bill was ordered to a first reading, and the amendment was ordered printed.

Mr. Jewell, from the Committee on Elections, to which was referred a bill, Senate Bill No. 83, for "An Act to amend section 2 of 'An Act to provide a method of voting at any special, general or primary election by electors expecting in the course of their business or duties to be absent from the county in which they are electors,' approved June 22, 1917, as amended."

Reported the same back with the recommendation that the bill do pass, and that it be ordered to a first reading.

Under the rules, the bill was ordered to a first reading.

Mr. Wood, from the Committee on Education, to which was referred a bill, Senate Bill No. 38, for "An Act to amend section 96 of 'An Act to establish and maintain a system of free schools,' approved June 12, 1909, as amended."

Reported the same back with the recommendation that the bill do pass, and that it be ordered to a first reading.

Under the rules, the bill was ordered to a first reading.

By Mr. Hamilton, Senate Bill No. 205, a bill for "An Act to amend section 6 of 'An Act to protect the public and the manufacturers of dairy products from frauds and imitations, and to prevent the public. from being deceived in the use of adulterated foods by providing for marking, stamping and branding of cans or other containers for the handling and transportation of dairy products; for the registration of such mark or brand and prohibiting the use of such marked can, bottle, or other containers for any other than the designated purpose; and for preventing the use of any such brand or mark of another; and from defacing or removing the same; and providing penalties for violation thereof; and making it the duty of the State Food Commissioner to enforce the law,' approved June 25, 1917."

By Mr. Telford, Senate Bill No. 206, a bill for "An Act to amend section 11 of Article II of 'An Act to revise the law in relation to the conservation of game, wild animals, wild fowls, birds, fish, mussels, frogs and turtles in the State of Illinois, and to repeal all Acts in conflict therewith,' approved June 24, 1919."

READING BILLS OF THE SENATE THE SECOND TIME.

Senate Bill No. 33, a bill for "An Act to prevent improper treatment of prisoners or persons accused or suspected of crime, by officers or other persons, for the purpose of attempting to obtain confessions. or admissions of guilt, and to provide a penalty therefor."

Which was recalled from the order of third reading on March 13, 1923, to the order of second reading for the purpose of amendment, was taken up for consideration.

Mr. Jewell offered the following amendments to the bill, which were adopted:

AMENDMENT No. 1.

Insert the word "physical" before the word "cruelty" in line 6.

AMENDMENT No. 2.

Strike out of line 6 of said bill the word "trickery."

AMENDMENT No. 3.

"or

Strike out of lines 9, 10 and 11 of said bill the following words: whoever, for the purpose of securing such confession or admission, gives or offers to give to any person any money or thing of value."

The question then being, "Shall the bill as amended be printed, transcribed and typed and ordered to a third reading?" it was decided in the affirmative.

On motion of Mr. Swift, Senate Bill No. 88, a bill for "An Act making an appropriation to the 'Vocational Rehabilitation Fund," on

the order of second reading, was referred to the Committee on Appropriations.

Senate Bill No. 34, a bill for "An Act to repeal ‘An Act to revise the law in relation to apprentices,' approved February 25, 1874, as amended."

Having been printed, was taken up and read at large a second time. And the question being, "Shall the bill be transcribed, typed and printed for a third reading?" it was decided in the affirmative.

Senate Bill No. 36, a bill for "An Act to amend section 1 of ‘An Act to revise the law in relation to divorce, approved March 10, 1874, as amended.”

Having been printed, was taken up and read at large a second time. And the question being, "Shall the bill be transcribed, typed and printed for a third reading?" it was decided in the affirmative.

Senate Bill No. 58, a bill for "An Act to amend an Act entitled, 'An Act to revise the law in relation to divorce,' approved March 10, 1874, in force July 1, 1874."

Having been printed, was taken up and read at large a second time. And the question being, "Shall the bill be transcribed, typed and printed for a third reading?" it was decided in the affirmative.

Senate Bill No. 73, a bill for "An Act to authorize drainage districts and special drainage districts to acquire, maintain and operate dredge boats and other necessary equipment for the construction and preservation of drains and ditches."

Having been printed, was taken up and read at large a second time. And the question being, "Shall the bill be transcribed, typed and printed for a third reading?" it was decided in the affirmative.

Senate Bill No. 81, a bill for "An Act to amend section 189 of 'An Act to establish and maintain a system of free schools,' approved and in force June 12, 1909, as amended."

Was taken up and read at large a second time, together with the following amendment thereto (which has been printed), reported from the Committee on Education March 8, 1923.

AMENDMENT No. 1.

Amend Senate Bill No. 81, section 189, line 30, by changing the word "unto" to "until," and by changing the word "of" after the word "city" in line 45 to "or."

The question being, "Shall the report of, and the amendment reported from, said committee be adopted ?" it was decided in the affirmative.

The question then being, "Shall the bill, as amended, be transcribed, typed and printed for a third reading?" it was decided in the affirmative.

Senate Bill No. 82, a bill for "An Act to amend an Act entitled, 'An Act to provide for the appointment of school directors and members of the board of education in certain cases,' approved May 29, 1879, in force July 1, 1879, as amended by subsequent Acts, by amending section thereof and adding another section to be known as section 8."
